ADMINISTRATIVE COURT ORDERS FULL TRIAL AGAINST LUHANSK REGIONAL ADMINISTRATION AND MANDATES PUBLIC NOTICE: THE BATTLE OVER HALF A BILLION IN HOUSING FUNDS

Nov 4, 2026, 12:16:21 PM

Attempts by the leadership of the Luhansk Regional Military Administration (OVA) to quietly derail our legal challenge and allocate 500 million UAH in housing funds behind closed doors have collapsed procedurally.

On November 2, 2026, the Dnipropetrovsk District Administrative Court, presided over by Judge Nataliia Kaluhina, issued a ruling in Case No. 160/34036/26. The court formally accepted Serhiy Stulov’s lawsuit and granted the plaintiff's key procedural motions for an open, public judicial examination.

On November 4, 2026, the court served an official summons (Doc. No. 0470_8985321) citing the Ministry of Justice of Ukraine to appear as a third party at the preparatory hearing scheduled for December 8, 2026.

1. General Proceeding Ordered: No Backroom Written Review

Judge Kaluhina rejected requests for an expedited, written-only proceeding without hearings, ruling in favor of the plaintiff's petition:

«The motion of Serhiy Petrovych Stulov to examine the case under the rules of general lawsuit proceedings is hereby granted. The adjudication of the case shall proceed under general proceedings with a preparatory court hearing scheduled».

The preparatory court hearing is scheduled for December 8, 2026, at 13:00 at the Dnipropetrovsk District Administrative Court (Dnipro, Akademika Chekmariova St., 5, Courtroom No. 2).

This guarantees that the proceedings will take place in open court with mandatory attendance, the cross-examination of documentary evidence, and full coverage by investigative journalists and civil monitors.

2. Mandatory Public Notice Imposed on the Regional Administration

Invoking Article 264 of the Code of Administrative Justice of Ukraine (KASU), the Court broke the administration's information embargo:

«The Luhansk Regional Military Administration is hereby ordered to publish an official notice regarding the initiation of proceedings in Case No. 160/34036/26 challenging Disposition... No. 452 in the publication where this act was or was required to be officially promulgated, and to submit proof of such publication to the Court».

By statutory requirement, this mandatory notice must appear no later than seven days prior to the preparatory hearing—meaning by December 1, 2026. Regional officials are legally obligated to formally notify the displaced population that their housing distribution decree is subject to an active court challenge.

3. Justice Ministry Registration Records and Anti-Corruption Review Subpoenaed

The court granted our motion for the production of evidence, ordering the Kharkiv Interregional Directorate of the Ministry of Justice to produce the full official registration file No. 24/24 concerning Disposition No. 452, specifically including its legal and anti-corruption expert assessments.

The trial will establish on the record which officials inside the justice apparatus approved an executive order that stripped thousands of 2022 IDPs of their housing rights, and whether internal examiners warned against the blatant corruption risks embedded in the scheme.

Additionally, the ruling notes that under previous court orders, the Luhansk OVA was already compelled to file copies of the challenged disposition alongside all internal explanatory records and source documentation.

Objectives and Legal Consequences of Invalidating Disposition No. 452

Official mouthpieces claimed that this lawsuit sought to "halt housing aid for large families and soldiers". This is a disinformation campaign designed to shield illicit allocations granted to ranking officials.

Our legal objectives remain clear:

  1. Dismantle IDP Segregation: Disposition No. 452 excluded displaced residents of Lysychansk, Sievierodonetsk, Rubizhne, Kreminna, and Popasna (the 2022 displacement wave), reserving 500 million UAH exclusively for an inner circle from four pre-selected districts. This occurred despite the funding being extracted from the treasury of frontline Lysychansk!
  2. Abolish the Opaque "Registry No. 2": We demand the liquidation of the closed-door priority list that enabled central Pension Fund executives, regional rescue service commanders, Ministry of Justice probation chiefs, and allied party operatives to secure prime real estate in Kyiv, Bucha, and Irpin with 50% non-repayable public debt forgiveness.

Direct Consequences of Annulment:

  • Immediate Halt to the Misappropriation of 500 Million UAH: Regional leadership will lose the authority to finalize the non-transparent distribution of half a billion hryvnias.
  • Mandated Adoption of an Open Framework: The administration will be compelled by court order to implement an equitable procedure where every registered displaced person from Luhansk Region—whether displaced in 2014 or 2022—has equal access via public, verifiable computerized random selection.
  • Absolute Record Transparency: An end to classified selection minutes and hidden appendices.
  • Evidentiary Base for Anti-Corruption Prosecution: An administrative court verdict of illegality will provide statutory evidence for ongoing criminal investigations by NABU and the SBU into abuse of authority (Article 364 of the Criminal Code) and misappropriation of public assets (Article 191 of the Criminal Code).

Public funds belong to the community, and the right to housing belongs to all victims of war, not a privileged bureaucracy.

The public hearing will convene on December 8, 2026, at 13:00 in Dnipro.
